IMO the bigger problem is the former owner/borrower fronting a
family member or friend as a tenant. With or without a lease, it gives
the more time. In CA, the former owner can be evicted asap. Now they
can come to the door and say they are a tenant. In CA there are cases
where someone in the house really is a tenant, a roommate or boarder
living with the former owner. As that tenant has rights, it mucks up
possession for the trustee sale buyer.Sure, you can try to prove that the tenant is the former owner and
committing fraud, but the time and costs aren't worth the 90 days.
And it's not hard to produce a year lease.........
