When folks are in the process of considering whether it will be Bk or foreclosure, they usually aren't of the ability to pick and choose. I realize that the question was theoretical, but most folks in that spot end up with BOTH, as opposed to one or the other...
Sure, if they could file for Bk and avoid the foreclosure, that is better of the two options. But who in that position gets that choice...?
