I am not sure what is legal but I would proceed with the eviction as if I did not know any better.Tenant may not show up or know enough to say the right thing.Also if the tenant shows up make a deal with them to keep it out of the judges hands.He will pay half this friday the rest next week,something like that,then when you stand in front of the judge you explain the deal.The tenant always seems to think you have to start over if they do not pay but in my area I just file the papers the first time they mis a payment and the judge signs it effectively keeping the judge from making a decision I do not like,in my area of upstate NY the judges routinely give the tenants a month to find a place if you do not know how to get around it
