Why do you think that the lender is responsible to pay for these items? Do you have some sort of contract with the lender that states this?
Also, can you prove that the current owner and the agents knew of these defects? It's possible that no one knew, so they couldn't disclose.
Does your contract have contingencies for these items, or is the house selling "as is"?
We definitely need more info here.
