You make some very valid points. Our sales contract was basic. No mention of joint responsibilities. I did not know the deposit should have gone into escrow first.
As a note; I just learned this week from the buyers that the deal fell through. I am more than willing to refund their deposit money, in fact I have already talked to them and set up a time to do so. I just wanted to know if I could hold my former partner legally responsible for the deposit refund not to mention that fact that I was screwed out of a 15 yr note.
Some hard lessons learned with this deal.
