I am a licensed Realtor in Texas. I have been asked the following and am determined to find the answer:

Question. Can a lawn service put a mechanics lein on a house after services have been rendered and the property owner fails to pay? We're only talking 50 Bucks! But it's a matter of principal at this point.

Facts: The lawn care provider is an independant.
An invoice for service was provided.
Written notices are documented.

Mechanic's lien law varies widele by locale. You can review the state statutes on-line to get an idea what they say (http://www.capitol.state.tx.us/) but to get a definative answer, you need to run this by a local attorney who specializes in real estate.

Statute is clear and readable, and tells exactly what, how, when everything has to be done to perfect a mechanics lien in TX.
